Deleted Snapchat messages can sometimes be recovered for litigation, but only within narrow windows. Unopened one-on-one Snaps are deleted from Snap's servers after 31 days, unopened group Snaps after just 7 days, and opened Snaps are typically deleted once viewed. Recovery depends on acting fast — and knowing where else the evidence lives.
As a testifying and consulting social media expert witness on 18 cases across 15 law firms — including criminal, personal injury, and IP matters where Snapchat evidence was central — I'm asked this question more than any other. Here's the answer attorneys actually need.
What Snapchat retains on its servers
Snapchat is designed for ephemerality, but "deleted from the app" and "gone forever" are not the same thing.
Based on Snap's published retention practices:
Opened Snaps: deleted from servers after all recipients have viewed them
Unopened one-on-one Snaps: deleted after 31 days
Unopened group Snaps: deleted after 7 days
Stories: available for 24 hours (users can delete earlier)
Memories: Snap's cloud storage — retained until the user deletes it. This is often the richest evidence source
Metadata and logs: Snap retains logs of roughly the previous 31 days of Snap activity — sender, recipient, timestamps — even after content is gone
The pattern that matters: content disappears fast; metadata and Memories persist. In my casework, the metadata trail — who sent what to whom, and when — has often been as probative as the content itself.

The four places deleted Snapchat evidence actually survives
The recipient's device. Screenshots, screen recordings, and saved-in-chat messages live on phones, not Snap's servers. Device-level discovery is usually more productive than a subpoena to Snap.
Snapchat Memories. Anything a user saved to Memories persists indefinitely. Users routinely forget what they've saved.
Snap's servers — if preserved in time. Law enforcement can issue preservation requests under 18 U.S.C. § 2703(f), which holds available records for 90 days, extendable once for another 90. Civil litigants face a harder path (see below).
The "My Data" download. Every Snapchat user can request their own account data export — a critical tool when your own client's account is at issue, because it requires no legal process at all.
Civil vs. criminal: two very different recovery paths
In criminal matters, law enforcement can serve preservation requests and search warrants directly on Snap through its law enforcement portal. In civil litigation, the Stored Communications Act generally bars Snap from producing message content in response to a civil subpoena. Civil attorneys instead rely on preservation letters to opposing parties, litigation holds, device discovery, and party-driven data exports.

What a social media expert adds
Snap Inc. explicitly does not provide expert witness testimony with its data productions. That means when Snapchat evidence is disputed — what the retention windows imply, whether deletion suggests spoliation, whether a screenshot is authentic — the explanation has to come from a qualified expert. In my engagements, that work has included interpreting platform mechanics for the court, evaluating preservation timelines, and assessing whether missing content was deleted in the ordinary course or in anticipation of litigation.
