For the first time, plaintiffs are not arguing that content on platforms like Meta, TikTok, Snap, and YouTube is harmful.


Instead, they are arguing something far more disruptive: That the platforms themselves are addictive products—and that this addiction has caused personal injury.


If successful, this legal theory could fundamentally alter how social media companies are regulated, litigated, and designed.


Why These Lawsuits Are Different From Everything Before

For years, social media companies have relied on two powerful shields: First Amendment protections, and Section 230, which protects platforms from liability for user-generated content.

The new lawsuits sidestep both.


Rather than focusing on speech or moderation decisions, plaintiffs argue that platform features were intentionally engineered to create compulsive use, especially among minors—and that this compulsive use caused measurable harm.


This is a product-liability and personal-injury theory, not a content-moderation one.


The Big Tobacco Comparison—and Why It Matters

Legal experts and journalists alike have described these cases as social media's "Big Tobacco moment."

  • Autoplay features automatically begin the next video when one ends. The user must actively decide to stop rather than actively decide to continue—a psychologically significant reversal.


Algorithmic Recommendation Systems

Modern social media platforms don't show content chronologically or randomly. Sophisticated algorithms curate what each user sees based on predicted likelihood of engagement, analyzing billions of data points to determine what will keep each individual user on the platform longest.


The algorithms optimize for engagement metrics—likes, shares, comments, time spent—rather than user wellbeing. This creates problematic dynamics: amplification of extreme content that generates more engagement, filter bubbles showing similar content in reinforcing loops, psychological profiling identifying emotional vulnerabilities, and comparison optimization serving idealized content to susceptible users.

Beauty Filters and Appearance Modification

Photo and video filters have become ubiquitous on social media platforms. While initially marketed as fun enhancements, many filters fundamentally alter facial structure, skin texture, and body proportions—creating versions of users that are simultaneously them and not them.


The mental health implications are significant: distorted self-perception where regular use makes users' actual appearance seem deficient, normalized unrealistic standards when most posted images are filtered, body dysmorphia triggers for vulnerable individuals, and even cosmetic surgery trends where plastic surgeons report patients requesting procedures to look like their filtered selfies.


Significantly, these effects disproportionately impact young people, particularly teenage girls, whose self-concept and body image are still developing.


Remedies Go Beyond Money

Plaintiffs are not only seeking damages. They are also asking courts to require:

  • Removal of addictive design features like infinite scroll and autoplay

  • Stronger age-verification systems

  • Expanded parental controls

  • Limits on algorithmic amplification for minors

  • Option to view chronological feeds rather than algorithmic ones

  • Mandatory time-limit reminders and usage tracking tools

  • Clear labeling of beauty filters and appearance-altering effects


Any one of these remedies would meaningfully disrupt the current social media business model.


Together, they would represent a fundamental restructuring of how platforms operate.

If juries accept that social media platforms are addictive by design, and that addiction can cause personal injury, then future litigation will expand rapidly.

Social media companies will deploy sophisticated strategies to defeat these claims. They will attack the scientific foundation, arguing that behavioral addiction lacks the same neurological markers as substance addiction, that no consensus diagnostic criteria exist for social media addiction, and that research shows mixed results.


They will emphasize that users make free choices—no one is forced to create an account or use platforms, users can delete apps or turn off notifications anytime, platforms offer usage tracking tools, and parents have ultimate control over children's device access.


Defendants will also highlight platform benefits: maintaining connections with friends and family, support communities for marginalized groups, access to information and educational content, creative expression opportunities, and mental health resources.


They will warn of broader consequences: liability would stifle innovation, platforms would become financially unsustainable, free services would disappear, and U.S. tech companies would lose competitive edge to foreign platforms.


Final Thought

For years, the harms of social media have been framed as cultural, parental, or personal failures.

These lawsuits ask a different question: What if the injury lies in the product itself?
