What Affects the Cost of a Social Media Expert Witness?

Several factors determine what you'll pay to retain a qualified social media expert witness:


Scope of work. A case requiring analysis of a single Instagram account is materially different from one involving cross-platform influencer campaigns, advertising data, and algorithm behavior across TikTok, YouTube, and Snapchat. More platforms and more data means more time.


Stage of engagement. I offer initial consultations at no charge to review case materials and assess fit. After that, fees break into phases: retainer and report preparation, deposition preparation and testimony, and trial testimony — each scoped separately.


Expert qualifications. Practitioners with hands-on platform experience, published work, and a track record of retained cases command higher fees than academics or generalists. For cases involving Daubert challenges, that credibility premium is worth it.

Timeline. Expedited engagements — cases with tight discovery deadlines or last-minute retention — typically carry a premium.

What Does My Retainer Cover?

My retainer covers: initial review of case materials and discovery documents; analysis of platform data, screenshots, analytics exports, and metadata; and drafting of an expert report, declaration, or affidavit. Deposition preparation, deposition testimony, and trial testimony are scoped separately based on actual time required.

Yes — and early retention often reduces your total cost.
